  2. You will not submit any false or fraudulent orders. If we have reasonable grounds to believe that an order is fraudulent, we reserve the right to cancel it and inform the relevant authorities.

By placing an order on this website, you confirm that you are over 18 years of age and possess the legal capacity to enter into binding contracts.

3. EXECUTION OF THE AGREEMENT

The information set out in these Terms and the details contained on this website do not constitute an offer for sale but rather an invitation to treat. No contract in respect of any products shall exist between you and us until your order has been expressly accepted by us.

To place an order, you must follow the online purchasing process and click on "Authorize Payment". You will legally receive an email acknowledging that we have received your order (the "Order Confirmation"). Note that this does not mean that your order has been accepted. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms that the product has been dispatched (the "Shipping Confirmation"). The contract for the purchase of a product between us (the "Contract") will only be formed when we send you the Shipping Confirmation.

The Agreement will only cover the products specified in the Shipping Confirmation. We are not obligated to supply any items ordered until we have confirmed their shipment through a Shipping Confirmation.

4. PRODUCT AVAILABILITY

All orders are subject to product availability. While we make every effort to display accurate stock levels, in the event of supply difficulties or if products are out of stock, we reserve the right to provide you with information about substitute products of equal or higher quality and value which you can order. If you do not wish to order the substitute products, we will reimburse any monies that you may have paid.

5. REFUSAL OF ORDER

We reserve the right to withdraw any product from this website at any time and to remove or edit any materials or content on this website. While we will make reasonable efforts to process all orders, there may be exceptional circumstances that require us to refuse to process an order after we have sent you an Order Confirmation. We reserve the right to do so at any time. We are not liable for any product removals, content changes, or refusal to process orders after confirmation.

6. SHIPPING AND DELIVERY

We offer worldwide shipping via Geniki Taxydromiki (Domestic/Greece) and DHL Express (International).

  • Delivery Address: Orders will be delivered to the address provided by you at checkout. It is your responsibility to ensure the address is correct. We are not responsible for lost packages due to incorrect or incomplete address information.
  • Delivery Timing: Subject to product availability, we will endeavor to fulfill your order for the product(s) listed in the Shipping Confirmation by the delivery date set out in the Shipping Confirmation or, if no estimated delivery date is specified, within a reasonable time.
  • Tracking: Once your order is dispatched, you will receive a notification with a tracking number.

Customs, Duties, and Taxes (International Orders):

For delivery to countries outside the European Union (EU), shipments are sent DDU (Delivered Duty Unpaid). This means:

  • Prices displayed on our site do not include local import taxes, customs duties, or clearance fees.
  • You constitute the importer of record and must comply with all laws and regulations of the destination country.
  • Payment of these charges is the sole responsibility of the recipient. We have no control over these charges and cannot predict their amount.
  • Refusal to Pay: If you refuse to pay these charges and the parcel is returned to us, we will deduct the return shipping costs, customs charges, and handling fees from your refund.

7. DELIVERY FAILURE

If delivery of your parcel fails after two attempts, the courier may leave a note explaining where your parcel is and how you can rearrange delivery or collect it. If you will be unavailable at the scheduled delivery time, please contact the courier directly.

If, for reasons beyond our control (e.g., incorrect address, refusal to accept, failure to pick up), the parcel is returned to us, we reserve the right to charge you for any costs incurred (including shipping and return fees) and terminate the Contract.

If your parcel has not been delivered within 15 days for reasons beyond our control, we will consider the Agreement canceled and process a refund for the products purchased within 30 days, minus any applicable return/termination costs.

8. TRANSFER OF RISK AND OWNERSHIP

The products will be at your risk from the time of delivery. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges, or upon delivery, whichever is later.

9. PRICE AND PAYMENT

The prices for each product are listed on our website, except in cases of obvious errors. Prices are listed in Euros (€) and include VAT (where applicable) but exclude delivery charges, which are added to the total amount due when stated.

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent an Order Confirmation.

We are not obligated to provide any product at an incorrect lower price, even after sending a Shipping Confirmation, if the error is clear and should have been recognized by you.

  • Payment Methods: We accept Visa, MasterCard, PayPal, Apple Pay, Google Pay, and Klarna.
  • Security: To minimize the risk of unauthorized access, your credit card details will be encrypted. By clicking "Authorize Payment", you are confirming that the credit card is yours or that you are the legitimate holder. Upon receiving your order, we will pre-authorize the amount on your card to ensure sufficient funds are available for the transaction, with the actual charge occurring when your order is shipped from our warehouse.

10. RETURN & EXCHANGE POLICY (RIGHT OF WITHDRAWAL)

10.1. Statutory Right to Cancel (EU Customers)

Under applicable regulations, you have the right to cancel your contract within 14 calendar days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire physical possession of the goods.

10.2. Returns Process

To exercise the right of withdrawal, you must notify us at maggina.brand@gmail.com within the 14-day period. You must send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this Contract.

  • Condition of Items: Items must be returned in their original condition: unworn, unwashed, with all original tags, labels, and packaging intact.
  • Return Costs: You will be responsible for the direct cost of returning the goods. We recommend using a trackable shipping service. We do not guarantee that we will receive your returned item.

10.3. Refunds

Once your return is received and inspected, if approved, your refund will be processed within 14 days. We will reimburse you using the same means of payment as you used for the initial transaction. We may withhold reimbursement until we have received the goods back.

10.4. Exceptions

The right of withdrawal does not apply to:

  • Goods made to the consumer’s specifications or clearly personalized.
  • Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (e.g., swimwear, earrings, underwear).
  • Last Chance / Sale Items: Products purchased from our "LAST CHANCE" section are final sale and cannot be returned unless they are faulty or if applicable local law mandates otherwise.

10.5. Faulty Products

If you receive a faulty or damaged product, please contact us immediately at maggina.brand@gmail.com with photos and a description of the defect. If the defect is confirmed, we will offer a replacement or a full refund, including delivery charges.

11. INTELLECTUAL PROPERTY

You acknowledge and agree that all copyright, trademarks, and all other intellectual property rights in all material or content supplied as part of the website (including images, logos, designs) shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorized by us. This shopping channel is for consumers only; re-sale, agency, or distribution of our products is prohibited.

12. LIABILITY AND DISCLAIMER

The company is only responsible for the purchase price of any product you buy, unless stated otherwise in specific cases.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.

Subject to the paragraph above, our total liability to you for any losses suffered as a result of us breaking this agreement is strictly limited to the purchase price of the product you purchased. We are not responsible for indirect losses which happen as a side effect of the main loss or damage (such as loss of income, loss of business, lost profits, loss of data, etc.).

Because the website is free to use, the company doesn't guarantee that the information on it is accurate or secure, as mistakes can happen. All product information on the website is provided "as is," without warranties of any kind.

13. EVENTS BEYOND OUR CONTROL (FORCE MAJEURE)

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event). Force Majeure Events include any acts or incidents beyond our control, such as strikes, lockouts, civil unrest, riots, terrorist acts, war, natural disasters (fires, storms, floods, earthquakes), epidemics, or inability to use public or private transport or communication systems.

14. OUR RIGHT TO AMEND THESE CONDITIONS

We reserve the right to modify these Conditions at any time. You will be bound by the policies and Conditions that are in effect when you use this website or when you place an order for products, unless we are legally required to implement retroactive changes.

15. GOVERNING LAW AND JURISDICTION

The use of our website and Contracts for the purchase of products through said website shall be governed by Greek Law.

Any dispute arising from, or related to the use of the website or to such Contracts shall be subject to the non-exclusive jurisdiction of the courts of Athens, Greece.
